TRIPLAH TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the TripLah website, applications, artificial-intelligence features, trip-planning tools and related services (collectively, the "Service").
Please read these Terms carefully. By creating an account, selecting an option indicating acceptance where one is presented, or otherwise accessing or using the Service after having a reasonable opportunity to review these Terms, you agree to be bound by them. TripLah's Privacy Notice explains how personal data is processed. If you do not agree to these Terms, do not use the Service.
1. Who operates TripLah
TripLah is operated by TRIPLAH SERVICES, a business registered in Malaysia under registration number 202603189247 (MA0349799-D) ("TripLah", "we", "us" or "our").
TripLah is currently operated as a Malaysian sole proprietorship.

If the business is restructured, incorporated, transferred or succeeded by a partnership, limited liability partnership, company or other lawful successor, TripLah may assign these Terms and operation of the Service as described in Section 26.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or use the Service.
By using TripLah, you represent that:
- you meet the applicable age and legal-capacity requirements;
- you are not prohibited from using the Service under applicable law;
- the information you provide is accurate and complete; and
- where you use TripLah to plan travel involving another person, you have the permission or other lawful authority needed to provide their information and use it for that planning purpose.
TripLah is not directed to children. A parent, guardian or other responsible adult planning travel involving a child remains responsible for the child, the information entered about the child and the resulting travel decisions.
3. What TripLah provides
TripLah currently provides trip-planning, recommendation, comparison and travel-information technology.
Depending on the features available, TripLah may help you:
- explore destinations, attractions, accommodation, flights, transport or activities;
- compare information supplied by third parties;
- create and manage travel preferences;
- generate, edit and save suggested itineraries;
- receive AI-generated recommendations and explanations;
- view estimated prices, distances, travel times, weather or other planning information;
- follow links to third-party websites or services; and
- discover promotions, activities or travel services offered by third parties.
Unless a feature is expressly identified as a paid service, TripLah's current consumer trip-planning features are provided without a charge payable directly to TripLah.
TripLah will not charge you merely because:
- you create an account;
- you use a feature currently described as free;
- you view or click an affiliate link; or
- these Terms refer to possible future paid services.
TripLah is a planning and information service. TripLah is not itself a provider of flights, accommodation, tours, attractions, transport, insurance or other travel products.
TripLah may add, remove or modify free features, subject to applicable law and any notice obligations in these Terms.
4. TripLah is not a booking or transaction party
TripLah does not:
- sell, issue or fulfil flights, accommodation, transport, tours or activities;
- accept instructions to make a third-party travel booking on your behalf;
- make or guarantee reservations;
- collect or process payment for third-party travel bookings;
- issue tickets, vouchers or booking confirmations;
- hold customer funds for travel providers;
- act as a travel provider, tour operator, airline, hotel, insurer or transport operator;
- control the performance of any third-party travel service; or
- become a party to a booking merely because you discovered a service through TripLah.
When you click a link or continue to a third-party provider, you leave TripLah. Any search, reservation, purchase, cancellation, payment or other transaction is made directly between you and the third-party provider.
The third-party provider, not TripLah, is responsible for matters relating to its transaction or travel product, including:
- the booking and payment process;
- the accuracy of the final price and availability;
- issuing tickets, vouchers and confirmations;
- providing the purchased service;
- changes, delays, cancellations, overbooking and refunds;
- taxes, fees and currency conversion;
- customer service and complaints relating to the booking; and
- compliance with laws applicable to its travel product.
You must review the provider's terms, privacy notice, cancellation policy and other conditions before completing a transaction.
A TripLah itinerary, saved item, price display, recommendation or link is not a reservation, ticket, voucher or booking confirmation.
Nothing in this Section excludes responsibility that applicable law places on TripLah for TripLah's own acts, omissions, representations or services.
5. Third-party providers
TripLah may display information from or link to airlines, hotels, online travel agencies, activity platforms, transport operators, map providers, weather services, review platforms and other third parties.
Third-party providers are independent from TripLah. Unless expressly stated, TripLah does not:
- own, control or operate them;
- act as their agent;
- endorse every product they offer;
- guarantee their licensing, financial standing or service quality; or
- make representations on their behalf.
Third-party services may be subject to restrictions involving age, identity, nationality, residency, health, accessibility, minimum group size, local law or other eligibility requirements.
TripLah is not responsible for a third party's independent website availability, security, conduct, content, pricing, privacy practices or contractual performance, except to the extent applicable law makes TripLah responsible for its own conduct in connection with that third party.
6. Affiliate links, commissions and sponsored placements
Some links, offers or recommendations displayed through TripLah are or may be affiliate links.
When you click an affiliate link or complete an eligible transaction with a third-party provider, TripLah may receive:
- a commission;
- a referral fee;
- an attribution payment;
- promotional consideration; or
- another commercial benefit from the third-party provider or affiliate network.
Any such commission or commercial benefit is paid by the third-party provider or affiliate network. TripLah does not collect the price of the third-party travel product from you and does not become a party to your transaction with the provider.
TripLah does not itself add a separate booking fee to a third-party provider's price merely because you used a TripLah affiliate link. However, third-party prices may vary by channel, time, location, currency, account status, promotion or other factors, and TripLah cannot guarantee that an affiliate offer is the lowest price available elsewhere.
TripLah will identify advertisements, sponsored placements, paid promotions or similar commercial content where required by law or where necessary to avoid misleading users.
Commercial arrangements may affect:
- which providers or offers are available through TripLah;
- whether a provider is included in a comparison;
- the prominence of a sponsored placement;
- the availability of promotional vouchers or discounts; and
- whether TripLah receives compensation following a referral.
Sponsored or paid placements will be distinguished from ordinary recommendations through appropriate labels such as "Sponsored", "Ad", "Promotion" or equivalent wording where appropriate.
Unless expressly labelled as sponsored, TripLah's recommendations may consider factors such as:
- your stated preferences;
- destination compatibility;
- estimated price or value;
- location and travel time;
- relevance to the requested itinerary;
- popularity and ratings;
- expected weather or crowd conditions;
- data quality and freshness;
- provider availability;
- the completeness of available information; and
- other factors explained within the Service.
TripLah does not guarantee that:
- every available provider, fare, property, activity or offer is displayed;
- every provider has been independently reviewed;
- a result displayed first is the cheapest option;
- a result displayed first is objectively the best option for every traveller; or
- an affiliate offer will remain available.
The final price, availability and contractual conditions shown by the third-party provider when you complete a transaction will govern that transaction.
6A. Future paid services and subscriptions
TripLah may introduce optional paid plans, subscriptions, premium features, usage-based services or other commercial offerings in the future.
Before you purchase or activate a paid service, TripLah will present the applicable information required by law and reasonably necessary to understand the purchase, which may include:
- price and currency;
- billing period;
- included features;
- usage limits;
- renewal terms;
- trial conditions;
- cancellation method;
- refund conditions;
- taxes and additional charges;
- payment processor; and
- supplemental terms.
TripLah will not convert a free account into a paid subscription or begin charging a recurring fee without your affirmative authorisation.
A reference in these Terms to a possible future paid service does not create:
- a present payment obligation;
- an automatic subscription;
- authority to charge an existing payment method;
- acceptance of future pricing; or
- consent to automatic renewal.
Where a paid subscription renews automatically, TripLah will disclose the recurring nature of the charge before purchase and will provide cancellation options in accordance with applicable law.
Paid plans, subscriptions, trials, renewals, cancellations and refunds may be governed by separate Subscription Terms, an order confirmation, a pricing page or another supplemental agreement presented before purchase.
6B. Future developer, API and reseller services
TripLah may introduce developer tools, API access, business integrations, white-label services, data services or other business-to-business offerings in the future.
Such services may allow an authorised customer to access defined TripLah technology, data, recommendations, itinerary functionality or other capabilities through an application programming interface or other integration.
No right to access, reproduce, redistribute, sublicense, resell or commercially exploit a TripLah API or integration exists unless TripLah expressly grants that right under applicable supplemental terms.
Future developer or API services may be subject to additional requirements concerning:
- account and business verification;
- API credentials and credential security;
- permitted applications;
- rate limits and quotas;
- usage-based charges;
- prohibited uses;
- technical documentation;
- attribution;
- data storage and caching;
- end-user notices and consents;
- security standards;
- monitoring;
- versioning and deprecation;
- suspension;
- support;
- service levels;
- intellectual-property rights;
- data-processing responsibilities; and
- upstream provider restrictions.
Certain developer or API functionality may depend on third-party services or data providers. TripLah may modify, replace, suspend or discontinue affected functionality where an upstream service changes its terms or technical interface, becomes unavailable, restricts resale or redistribution, creates a security or legal issue, or can no longer lawfully or commercially be supplied.
TripLah will not represent that a third-party API or dataset can be resold, sublicensed or redistributed unless TripLah has obtained the necessary rights.
API customers may be required to agree to separate API and Developer Terms, an Acceptable Use Policy, a Data Processing Agreement, an order form, a service-level agreement or other supplemental terms.
6C. Supplemental terms
Certain features, products, promotions, subscriptions, developer tools, APIs or business services may be governed by additional terms presented when you access, activate or purchase them.
Supplemental terms may include:
- Subscription Terms;
- Cancellation and Refund Policies;
- Promotion or Voucher Terms;
- API and Developer Terms;
- API Acceptable Use Policies;
- Data Processing Agreements;
- Service-Level Agreements;
- order forms;
- enterprise agreements; or
- feature-specific notices.
Supplemental terms form part of your agreement with TripLah only if they apply to a service you use and are presented or accepted in a manner sufficient under applicable law.
If supplemental terms conflict with these general Terms, the supplemental terms will control only in relation to the specific feature, product or service they govern.
Nothing in future or supplemental terms removes mandatory consumer, privacy or other statutory rights that cannot lawfully be excluded.
TripLah may require separate affirmative acceptance of supplemental terms before providing the relevant service.
7. Prices, availability and comparison information
Prices, exchange rates, schedules, travel times, availability, taxes, fees, ratings and other third-party information may change at any time.
Displayed prices may:
- be estimated or cached;
- exclude taxes, service charges, baggage fees, resort fees or other charges;
- depend on currency, residency, occupancy, dates or provider eligibility;
- be subject to limited availability;
- differ from the price shown at final checkout; and
- be supplied by a third party that has not yet updated its information.
The price, availability and conditions shown by the third-party provider at the time you complete a transaction are controlling for that transaction.
TripLah does not provide a price guarantee unless a specific written guarantee is expressly displayed for a particular TripLah feature.
Currency conversions are estimates for planning convenience and may differ from the amount charged by a bank, card issuer or provider.
Nothing in this Section permits TripLah to make false or misleading representations about prices or offers.
8. Artificial-intelligence features
Some TripLah features use artificial intelligence, language models, machine-learning systems, optimisation engines or other automated tools to generate, summarise, rank or arrange content. AI-generated responses are generated by an automated system rather than a human adviser.
TripLah may use third-party AI technology to provide these features. The current material AI provider and relevant personal-data processing information are identified in the TripLah Privacy Notice. TripLah may change AI providers from time to time, subject to applicable law and the Privacy Notice.
AI-generated output may include:
- destination suggestions;
- itinerary drafts;
- summaries and explanations;
- estimated budgets;
- suggested activities;
- transport sequences;
- travel-time estimates;
- preference inferences;
- packing suggestions;
- conversational responses; and
- changes to an existing itinerary.
AI output is generated from information available to TripLah and may be incomplete, inaccurate, outdated, unsuitable, inconsistent or non-unique. AI systems may misunderstand your request or generate information that appears convincing but is wrong.
You must independently verify important information, including:
- visa, immigration and entry requirements;
- passport validity requirements;
- safety and security advice;
- health, vaccination and medication requirements;
- accessibility;
- weather and natural hazards;
- opening hours;
- transport schedules;
- prices and availability;
- local laws and customs; and
- booking and cancellation conditions.
TripLah's AI output does not constitute legal, immigration, medical, safety, financial or insurance advice. Do not rely on TripLah as the sole source for decisions that could materially affect your health, safety, legal status or financial position.
TripLah does not guarantee that an AI-generated itinerary is safe, feasible, accessible, lawful or suitable for every traveller.
Where required by applicable law, TripLah will provide appropriate transparency that you are interacting with an AI system or that content has been generated or materially manipulated by AI.
9. User travel responsibilities
You are responsible for your own travel decisions and, as applicable, for:
- deciding whether and where to travel;
- checking official government travel advice;
- holding valid passports, visas, permits and travel documents;
- complying with entry, transit and immigration requirements;
- reviewing health and vaccination requirements;
- assessing personal health, mobility and accessibility needs;
- obtaining appropriate travel and medical insurance;
- confirming operating hours, reservations and local transport;
- complying with laws, cultural requirements and provider rules;
- protecting your belongings and personal safety;
- ensuring activities are suitable for the relevant travellers; and
- allowing sufficient time for connections and travel disruptions.
Conditions can change rapidly. You should confirm important information through official government, provider or other authoritative sources shortly before travel.
Nothing in this Section transfers to you a responsibility that applicable law places on TripLah for TripLah's own Service.
10. Accounts and account security
You may need an account to use certain features.
You agree to:
- provide accurate and current registration information;
- keep login credentials confidential;
- use a strong and unique password;
- take reasonable steps to prevent unauthorised access to your account;
- promptly update changed information; and
- notify TripLah promptly of suspected unauthorised access.
You are responsible for activity conducted through your account to the extent that the activity is reasonably attributable to your use or failure to protect credentials. You are not responsible for activity caused by TripLah's breach of applicable security obligations or by circumstances for which applicable law places responsibility on TripLah.
You must not sell, transfer, lend or share an account in a way that compromises security or allows another person to impersonate you.
TripLah may require verification or suspend access where reasonably necessary to protect an account, investigate misuse or comply with law.
11. User Content and trip information
"User Content" means information or material you submit to the Service, including travel prompts, preferences, trip plans, saved places, messages and feedback.
You retain any rights you hold in your User Content.
You grant TripLah a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt and display User Content only to the extent reasonably necessary to:
- provide requested Service functionality;
- generate requested AI responses;
- save and synchronise trip plans;
- secure and maintain the Service;
- troubleshoot problems;
- comply with law; and
- analyse and improve TripLah where permitted by the Privacy Notice, applicable law and your applicable choices.
This licence does not transfer ownership of your User Content to TripLah. It ends when the relevant User Content is deleted from active systems, subject to lawful retention, security records, backups, de-identified information and other exceptions described in the Privacy Notice.
You represent that:
- you have the right or lawful authority to provide the User Content;
- providing it does not infringe another person's rights;
- you will not knowingly submit unlawful content; and
- where it contains another traveller's personal information, you have the permission or other lawful basis needed to provide it.
Do not enter passwords, complete payment-card numbers, government identification numbers, complete medical records or other unnecessary sensitive or confidential information into AI chat. Additional information about AI processing and sensitive personal data is provided in the Privacy Notice.
11A. AI-generated output and rights
AI-generated output may not be unique. The same or similar output may be generated for other users, and some AI-generated material may not qualify for intellectual-property protection in every jurisdiction.
To the extent TripLah holds transferable rights in AI-generated output created specifically in response to your lawful use of the Service, TripLah permits you to use that output for lawful personal or business purposes, subject to these Terms, applicable law and any third-party rights.
This permission does not transfer or license:
- TripLah's software, branding, interface, databases or other pre-existing intellectual property;
- third-party trademarks, images, text, data or other protected material that may appear in an output; or
- rights that TripLah does not own or have authority to grant.
TripLah does not guarantee that AI-generated output is unique, copyrightable, registrable, free from third-party rights or suitable for commercial exploitation. You are responsible for reviewing and, where appropriate, obtaining professional clearance before using AI output in a way that could materially affect another person's rights or be published commercially.
12. Acceptable use
You must not use TripLah to:
- violate any applicable law or another person's rights;
- submit unlawful, fraudulent, defamatory or infringing material;
- impersonate another person or misrepresent your affiliation;
- generate or facilitate fraudulent, deceptive, exploitative, hateful, harassing, sexually explicit, violent-extremist, terrorist or otherwise unlawful or seriously harmful content through AI features;
- exploit, endanger or unlawfully target children or vulnerable persons;
- interfere with the operation or security of the Service;
- introduce malware or malicious code;
- probe, scan or test vulnerabilities without written authorisation;
- bypass access controls, rate limits or technical restrictions;
- scrape, crawl or extract data through automated means except as expressly permitted;
- reverse engineer the Service except where applicable law expressly permits it;
- use the Service to develop or train a competing model or database without permission where such restriction is lawful;
- obtain unauthorised access to an account or system;
- overload or disrupt the Service;
- use TripLah outputs to mislead, defraud or unlawfully harm another person;
- submit personal data that you have no right or lawful basis to process;
- use the Service for commercial resale without a separate written agreement; or
- use the Service in violation of export-control, sanctions or similar laws that legally apply to you, TripLah or a material underlying service provider.
TripLah may investigate suspected misuse and take proportionate action, including limiting, suspending or terminating access.
AI features may also be subject to technical safety restrictions necessary for TripLah to comply with applicable law or the terms governing material upstream AI services. TripLah will not use this sentence to impose undisclosed payment obligations or materially different consumer terms without appropriate notice.
13. Intellectual property
TripLah and its licensors own all rights in the Service, including its software, interface, branding, designs, databases, original content and related intellectual property, excluding User Content and third-party content.
Subject to these Terms, TripLah grants you a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal trip planning or authorised internal business use.
You may not copy, distribute, sell, license, modify or create derivative products from the Service except where expressly permitted by TripLah or applicable law.
Third-party trademarks, logos and content belong to their respective owners. Their appearance on TripLah does not imply ownership, endorsement or partnership unless expressly stated.
14. Copyright and intellectual-property complaints
If you believe content available through TripLah infringes your intellectual-property rights, send a notice to contactus@triplah.com.my containing enough information for TripLah to assess the complaint, including where applicable:
- your name and contact information;
- identification of the protected work or right;
- identification and location of the allegedly infringing material;
- an explanation of your rights and the alleged infringement;
- a statement that your notice is accurate and made in good faith; and
- any signature or confirmation required by applicable law.
TripLah may remove or restrict access to material while reviewing a sufficiently supported complaint.
15. Feedback
You may provide suggestions or feedback voluntarily.
To the extent permitted by law, you grant TripLah a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use and incorporate feedback without compensation or attribution, provided that TripLah does not publicly identify you without permission.
This section does not transfer ownership of your private trip plans, personal data or other User Content merely because it is submitted through the Service.
16. Privacy
TripLah processes personal data in accordance with the TripLah Privacy Notice.
When you use third-party provider links, the provider may process information under its own privacy notice. TripLah does not control how an independent provider processes information after you leave the Service, except to the extent TripLah remains responsible for its own disclosures, transfers or other processing under applicable law.
The Privacy Notice explains TripLah's data practices and is not intended to reduce contractual or statutory rights under these Terms or applicable law.
17. Service availability and changes
TripLah may add, modify, restrict or discontinue features.
The Service may be unavailable because of maintenance, security incidents, provider failures, network issues, force majeure or other causes. TripLah does not guarantee uninterrupted or error-free operation.
Where reasonably practical and appropriate to the nature of the change, TripLah will try to avoid unnecessary disruption and provide notice of material changes.
TripLah does not promise a particular uptime percentage or service credit unless a separate written service-level agreement expressly applies to you.
Nothing in this Section removes remedies or guarantees that applicable consumer law makes mandatory.
18. Beta, experimental and sample features
Some features may be labelled beta, preview, demo, experimental or sample.
Such features may:
- be incomplete;
- use simulated, cached or sample information;
- change without notice;
- produce unexpected results; or
- be withdrawn.
TripLah will use reasonable labelling to distinguish simulated or sample information from confirmed live information where the distinction is material.
You should not rely on a beta, demo or sample feature for critical travel decisions.
19. Warranties and mandatory consumer guarantees
TripLah aims to provide the Service with reasonable care and skill. However, because TripLah depends on changing third-party information and automated systems, TripLah cannot promise that every recommendation, itinerary, price or item of travel information will always be complete, current or error-free.
To the maximum extent permitted by law, and subject to any mandatory statutory guarantees, the Service is provided on an "as is" and "as available" basis.
TripLah does not warrant that:
- every recommendation will meet your needs;
- information will always be complete, current or accurate;
- every itinerary will be feasible;
- every provider or offer will remain available;
- the Service will be uninterrupted or error-free;
- every defect will be corrected; or
- use of TripLah will produce a particular travel experience or financial outcome.
Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, remedy or consumer right that cannot lawfully be excluded or contracted out of, including any applicable mandatory rights under Malaysian consumer law.
20. Liability
Nothing in these Terms excludes or limits liability to the extent that doing so is prohibited by applicable law. This includes liability or remedies that cannot lawfully be excluded or restricted in relation to fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where applicable law prohibits limitation, breach of non-excludable statutory guarantees, or any other non-excludable liability.
TripLah remains responsible for its own breach of these Terms and for failure to exercise any standard of care that applicable law requires from TripLah.
To the extent permitted by law, TripLah is not responsible for loss or damage to the extent caused by:
- an independent third-party travel provider's act, omission, cancellation, delay, insolvency, overbooking or non-performance;
- a booking, payment or transaction made directly with a third party;
- inaccurate information supplied by an independent third party or by you, where TripLah did not know and could not reasonably have been expected to know that the information was inaccurate;
- changes in visa, border, health or travel requirements after relevant information was generated;
- your reliance on AI-generated output without reasonably verifying important information identified in Section 8;
- weather, natural disasters, civil disruption or other events outside TripLah's reasonable control; or
- your failure to take reasonable steps to protect your account or maintain copies of information that TripLah expressly allows you to export or retain.
The exclusions above do not apply to the extent the relevant loss was caused or materially contributed to by TripLah's own breach, negligence or other conduct for which applicable law makes TripLah responsible.
Consumer users
If you use TripLah as a consumer, your mandatory consumer rights and remedies remain unaffected. TripLah does not impose a monetary liability cap where applying such a cap would unlawfully restrict a mandatory consumer right or remedy.
To the extent permitted by applicable consumer law, TripLah is not responsible for losses that were not a reasonably foreseeable result of TripLah's breach or that arise from business or commercial activity unrelated to your personal use of the Service.
Business or non-consumer users
If you use the Service wholly or mainly for business, professional or commercial purposes and mandatory consumer-law protections do not apply, then, to the maximum extent permitted by law and subject to the first paragraph of this Section, TripLah's total aggregate liability arising from or relating to the Service will not exceed the greater of:
- the amount you paid directly to TripLah for the relevant Service during the 12 months before the event giving rise to the claim; or
- RM100.
For such business or non-consumer users, TripLah will not be liable for indirect or consequential loss, loss of profit, revenue, business opportunity or anticipated savings to the extent such exclusion is permitted by law.
21. Responsibility for third-party claims
To the extent permitted by law, you may be required to reimburse TripLah for reasonable losses, liabilities or costs arising from a third-party claim to the extent directly caused by:
- User Content you knowingly submitted without the rights or authority required to submit it;
- your intentional fraud or unlawful use of the Service;
- your material breach of these Terms that causes the third-party claim; or
- personal data you knowingly submitted without permission or another lawful basis where one was required.
TripLah will provide reasonable notice of a covered third-party claim and, where appropriate, allow you to participate in its defence.
This Section does not require you to reimburse TripLah for loss caused by TripLah's own negligence, misconduct, breach of law or breach of these Terms, and it does not remove any protection that mandatory consumer law provides to you.
22. Suspension and termination
You may stop using TripLah or request account deletion at any time, subject to the Privacy Notice and any applicable supplemental terms for a future paid service.
TripLah may restrict, suspend or terminate access where reasonably necessary because:
- you materially breach these Terms;
- your account creates a security risk;
- your use is unlawful or fraudulent;
- TripLah is required to do so by law;
- a material upstream service needed to provide the feature becomes unavailable or legally unusable; or
- the Service or relevant feature is discontinued.
Where appropriate and reasonably practicable, TripLah will provide notice and an opportunity to correct the issue before termination, unless immediate action is reasonably necessary for security, legal compliance, prevention of harm or another legitimate reason.
Termination does not affect provisions intended to survive, including intellectual-property, liability, dispute and lawful record-retention provisions.
Account and data deletion are governed by the Privacy Notice.
23. Complaints and dispute resolution
Contact TripLah first at support@triplah.com.my and provide enough information to understand and investigate the issue. Helpful information may include:
- the nature of the issue;
- relevant dates;
- the account email, where applicable;
- the outcome requested; and
- supporting information that is reasonably relevant.
Do not send passwords or complete payment-card or identity-document details by ordinary email.
TripLah will acknowledge and investigate complaints within a reasonable period.
These Terms do not prevent you from making a complaint to a consumer, privacy or other regulator, using a tribunal, or bringing a claim in a court where applicable law gives you that right.
The parties should attempt in good faith to resolve a dispute informally before commencing formal proceedings where reasonably practicable, unless urgent relief is required or applicable law allows immediate proceedings.
24. Governing law and jurisdiction
These Terms are governed by the laws of Malaysia.
Subject to any mandatory consumer rights, choice-of-law rules or jurisdictional protections that apply to you, the courts of Malaysia will have jurisdiction over disputes relating to these Terms or the Service.
If the law where you ordinarily reside gives you mandatory rights or permits you to bring a consumer claim in your local courts or tribunal, nothing in these Terms removes those rights.
25. Changes to these Terms
TripLah may update these Terms to reflect:
- changes to the Service;
- new features;
- changes in law;
- security requirements;
- changes in providers or business structure; or
- clarification of existing provisions.
The revised Terms will show a new "Last updated" date.
For material changes, TripLah will provide reasonable notice through the Service, by email or by another appropriate method. Where applicable law requires renewed or affirmative acceptance, TripLah will request it before the relevant change becomes binding.
Changes will not apply retroactively where prohibited by law.
If you do not accept materially revised Terms, you may stop using the Service and request account deletion, subject to applicable law and any obligations already accrued.
26. Assignment, business restructuring and successors
You may not assign or transfer your rights or obligations under these Terms without TripLah's prior written consent, except where applicable law gives you a non-waivable right to do so.
TripLah may restructure, transfer or assign the operation of the Service and these Terms to:
- a partnership formed to continue the TripLah business;
- a limited liability partnership;
- a company incorporated to operate TripLah;
- an affiliate or related entity;
- a purchaser of all or substantially all of the TripLah business or assets;
- an entity involved in a merger, acquisition, financing or reorganisation; or
- another lawful business successor.
Any assignment must be made in accordance with applicable law.
Where these Terms are transferred, the successor must assume the obligations applicable to the Service from the effective date of the transfer.
TripLah will provide notice where:
- required by law;
- the legal entity responsible for the Service changes;
- the transfer materially affects your contractual rights; or
- new consent is legally required.
A transfer does not automatically authorise the successor to use personal data for materially different purposes. Personal-data transfers and changes of controller will be handled in accordance with the Privacy Notice and applicable data-protection law.
If you do not accept a material change resulting from a business transfer, you may stop using the Service and request account deletion, subject to lawful retention and any obligations already accrued.
The provisions of these Terms that are intended to survive a transfer, restructuring or termination will continue to apply.
27. General provisions
These Terms, together with any applicable supplemental terms that you validly accept, constitute the contractual agreement between you and TripLah concerning the Service, unless a separate written agreement applies.
The Privacy Notice explains TripLah's processing of personal data. It does not itself create a separate payment obligation or reduce rights provided by these Terms or applicable law.
If a provision of these Terms is invalid or unenforceable, it will be modified or severed only to the minimum extent necessary under applicable law, and the remaining provisions will continue in effect.
A failure to enforce a provision is not a waiver of that provision or any other right.
Headings are for convenience only.
The words "including" and "includes" mean "including without limitation" unless the context requires otherwise.
Nothing in these Terms creates an employment, partnership, joint venture, fiduciary or agency relationship between you and TripLah.
No person other than you, TripLah and a permitted successor has a right to enforce these Terms, except where applicable law or an applicable supplemental agreement provides otherwise.
27A. Electronic notices
Where permitted by law, TripLah may provide contractual, account, security or legal notices electronically, including through the Service or to the email address associated with your account.
You should keep your account email address current.
This Section does not itself constitute consent to receive marketing communications. Marketing communications are handled in accordance with the Privacy Notice and applicable law.
28. Language
These Terms are intended to be available in English and Bahasa Malaysia.
The versions are intended to have the same substantive meaning. If there is a conflict between language versions, the English version will control only to the extent permitted by applicable law. A Bahasa Malaysia or other local-language version will control to the extent applicable law requires it.
Additional translations may be provided for convenience.
